| Page one: To the Honorable the judge of the circuit court in and for the county of Ste Genevive the petition of Margaret Butcher by Thomas Oliver her next friend respectfully sheweth that your petitioner was several years since married to one Michael Butcher in the county of Cape Girardeau agreeably to the laws of this Territory that she has ever since resided in said Territory and for more than twelve months past in the said county of Ste Genevive.That from the time of her intermarriage with the said Michael Butcher she continued to live with him and to perform and discharge the duties of a constant faithful and affectionate wife and that their union was blessed with three children,that contrary to the obligation of the marriage vows of the said Michael most solemuly made to your said petitioner he the said Michael for several years last past so cruely and ?_ acharousty? used and _____ your petitioner as apparently to endanger her life and on the twentieth day of December in the year 1817 vioently beat abused and turned your petitioner out of doors without the slightest cause or provocation and has ever since that time maliciously abandoned your said petitioner Page 2 PAGE 2 : and his family in violation of his said marriage and the most sacred ties of connibial and parental affection wherefore your petitioner prays your honors to grant her a divorce from the bed and board of the said Micharl Butcher and to grant her such other relief in the premises as by law she is entitled to your petitioner as in duly sound pray &_ Cook atty for ptr Margaret Butcher County of Ste Genevive Territory of Missouri The above named Margaret Butcher being duly sworn says that the facts stated in the foregoing petition,are true to the best of her knowledge and belief and that said complaint is not made out of vanity or by collusion between her and the said Michael Butcher,nor from her or restraint of the said Michael nor for other mere purpose of being freed and separated from the said Michael but in sincerity & truth for the causes mentioned in her said petition. Michael Butcher vs Peggy Butcher Divorce This day comes the def't Michael Butcher and made ?oath? that Nancy Delvy who lives in the county of Perry is a material witness for him. That he has had the said witness subpoenaed & that she fails to attend the def't ______ and believes to prove by the witness the plaintiff having committed adultry.This affiant further states that the witness is not about by his consent or convienance. Peggy Butcher vs Michael Butcher Petition for divorce The def't in this case makes makes oath that Robert Crump is a material witness for him upon the trial of this divorce,this ?affiant? further says that he understood the said Crump lived in the State of Tennessee near the mouth of Duck River and making inquiry concerning his residence in order to get a dedi_ _ __ to take his Deposition he has been informed that the said Crump lives on the other side of Big Black River & does not know whether it is in this state or the Territory of Arkansas. This ?affiant? says that the discovry of the place of residence of the said Crump was made too late to take the ordinary steps to get his deposition to this court.The said Crump is ?absent? that he great reason to believe he can ?prouire? the Evidence of the said witness against next term of this court that he can't go safely to trial without Evidence of such witness and that he cannot prove the same fact by any other witness that he knows of that this ?affia____? it is not made for the purpose of delay but in order to have justice done him. Thurs. June 14, 1821 On Petition for a divorce Peggy Burcher who sued by Thomas Oliver her next friend vs Michael Butcher This day came the parties aforesaid by their attonies and there also came a Jury towit: Louis Griffar, William Murphy Felix Valle' Benjamin Anourniux (?) Jean Bth Bapier/s/n? Nicholas Mayo?h (Mayor)? William L Gillard, Daniel H Rose, Charles C Albert Ferdinand Rozier William Murphy and also Jesse McFarland twelve good and lawful men who being duly Sworn to try the issue in this behalf on their oaths aforesaid say, that they find the defendant Michael Butcher guuilty of the desertion and cruel treatment as charged by the complainant in her libel, and that the complainant Peggy Butcher is not guilty of the adultry charged in the defendants answer. The court adjourned until tomorrow morning at 8 oClock |

Divorce Tues Jun 19 1821 Peggy Butcher who sued by Thomas Oliver her next friend vs Michael Butcher And it is now ordered and decreed, and the Court do order and decree that the said Peggy and Michael be henceforth separated from the bonds of matrimony and their marriage null and void forever, and it is further decreed and adjudged that the said Peggy recover of the Said Michel her costs and charges in and about her suit in this behalf expended. |
